What is Felony Battery in Florida?

In Florida, Felony Battery (based on a prior battery) is a third degree felony. In addition to fines, court costs, and other requirements, you can receive up to 5 years in state prison.

To prove the crime of Felony Battery (based upon a prior battery), the State must prove the following elements beyond a reasonable doubt:

1.       The Defendant actually and intentionally touched or struck the victim against his/her will or caused bodily harm to the victim.

2.       The Defendant has previous been convicted of Battery, Felony Battery or Aggravated Battery.
