What is Battery in Florida?

In Florida, Battery is a first degree misdemeanor. In addition to fines, court costs, and other requirements, you can receive up to 1 year in county jail.


To prove the crime of Battery, the State must prove one of the following elements beyond a reasonable doubt:

  1. Defendant actually and intentionally touched or struck the victim against his/her will; or

  2. Defendant intentionally caused bodily harm to the victim.
